Public Works

For many years we have acted for requiring authorities seeking to acquire land for road, landfills, pipelines and network infrastructure. We advise landowners who are facing their properties being acquired. We are fully familiar with the negotiations involved and the "good faith" acquisition processes and the objection process which can follow - also the less frequently utilised provisions of the Public Works Act regarding access for survey and investigation.

Our familiarity and experience with the Resource Management Act 1991 means we have involvement in notice of requirement processes at first instance and the Environment Court. We also appear in the Land Valuation Tribunal and have successfully negotiated full compensation where land has been taken for road, including a number of equivalent reinstatement cases under section 65 Public Works Act 1981. We are also familiar with the offer back provisions of the Public Works Act and the mechanisms found in section 50 relating to transfer of land between the Crown and territorial authorities.
