Brookfields has extensive experience in providing advice to insurance companies on a wide range of insurance policies. Our specialist services include advice on professional indemnity, general, statutory and public liability, employer, directors and officers liability and property insurance policies.

We regularly defend the insureds on behalf of insurers, where indemnity is accepted, in respect of claims relating to a broad range of insurance policies. Generally, these will settle at or prior to mediation. If however it is necessary to proceed to litigation, we have the experience to defend such claims in Court.

Where the insured is in liquidation, Brookfields regularly defend claims under section 9 of the Insurance Law Reform Act. Further, where an insurance pay out has been made, we are often required to pursue recovery claims, utilising the insurer's subrogated rights under the insurance policy.

The insurer/legal service provider relationship is unique, as it usually involves dealing with a third party, the insured, and its business needs. Brookfields understands this tri-partite relationship. We always seek to ensure that it is managed in a way that does not compromise the insurer's position, but which also recognises and respects the insured's needs.

What we do:

  • Advising on claims under policies and indemnity insurance
  • Mediation/settlement negotiations in respect of claims
  • Defending claims
  • Recovery of claims by way of insurer's subrogated rights under the policy
