Prosecutions and Enforcements

Whether you are on the receiving end of enforcement action or responsible for ensuring compliance with statutes such as the Resource Management Act 1991, the Dog Control Act 1996, Fencing of Swimming Pools Act 1987 or Building Act 2004, our team has the experience to help. Enforcement action may take the form of abatement notices or enforcement orders (such as those available under the Resource Management Act 1991), or it may involve infringement proceedings leading to instant fines, or even prosecution in the courts.

We have been involved in both prosecutions and defending enforcement action for many years and we understand the dynamics of and principles applying to both. Brookfields has excellent litigators who can assist as little or as much as required. We can provide advice to guide in-house enforcement officers or legal officers/inhouse counsel, assist in the filing of proceedings and preparation of evidence, pick the case up at the hearing stage, or run the whole case in its entirety.

For those facing an enforcement procedure, we can assess the strength of the case against them, communicate with the enforcing authority and advise on the best strategy to ensure a speedy resolution. If necessary we can prepare a plea in mitigation to limit the damage.
