Updated Environment Court Practice Note

The Environment Court has just released a new version of the Environment Court Practice Note. The updated Practice Note will come into effect on 1 November 2011 and will replace all earlier versions.

What has changed?

Minor amendments have been made throughout the Practice Note, and significant amendments have been made to the Court's procedures regarding mediation, the presentation of evidence at hearings, and with regard to expert witness conferencing.

Conferencing

The Court now expects that expert conferencing will occur prior to a hearing as a matter of course. The Practice Note also indicates that in many circumstances conferencing will occur before full briefs of evidence are prepared, with the conference proceeding on the basis of summarised 'will say' briefs being exchanged beforehand.
