Government Plans Reversal of Recent Resource Consent Notification Changes to The Resource Management Act

Amendments to the consenting and notification provisions of the Resource Management Act 1991 (RMA) came into effect on 18 October 2017, altering how resource consent applications are processed, and how notification and affected persons are determined.

Now less than a month in, the new Minister for the Environment, David Parker, has announced plans by the Government to reverse the changes which removed public notification and appeal rights for discretionary resource consent decisions by councils. The changes referred to are those in section 120(1A) of the RMA, which provides that a decision on a boundary activity, subdivision or residential activity may only be appealed if they are non-complying activities.
